Appeal from the United States District Court for the District of South Carolina, at Charleston. Solomon Blatt, Jr., Senior District Judge. (CR-79-64)

Victor Manuel Santiago, Appellant Pro Se.

Bruce Howe Hendricks, Office of the United States Attorney, Charleston, South Carolina, for Appellee.

D.S.C.

AFFIRMED.

Before RUSSELL and MURNAGHAN, Circuit Judges, and CHAPMAN, Senior Circuit Judge.

PER CURIAM:

OPINION

1

Appellant appeals from the district court's order denying his Motion to Correct Sentence under former Fed. R. Crim. P. 35(a).* Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. Santiago, No. CR-79-64 (D.S.C. Feb. 22, 1993). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

AFFIRMED

*

Santiago's motion was determined under the version of Rule 35(a) in effect at the time of his sentence in 1981
