62 F3d 1414 Borromeo v. States

62 F.3d 1414

Abel Parama BORROMEO, Petitioner-Appellant,
v.
United STATES of America, Respondent-Appellee.

No. 95-6483.

United States Court of Appeals, Fourth Circuit.

Submitted July 25, 1995.
Decided August 10, 1995.

NOTICE: Fourth Circuit Local Rule 36(c) states that citation of unpublished dispositions is disfavored except for establishing res judicata, estoppel, or the law of the case and requires service of copies of cited unpublished dispositions of the Fourth Circuit.

Abel Parama Borromeo, Appellant Pro Se. William David Wilmoth, United States Attorney, Rita R. Valdrini, Assistant United States Attorney, Wheeling, WV, for Appellee.

Before WILKINS, NIEMEYER, and MICHAEL, Circuit Judges.

PER CURIAM:

1

Appellant appeals from the district court's order denying his Fed.R.Civ.P. 59(e) motion to reconsider the dismissal without prejudice of his 28 U.S.C. Sec. 2255 (1988) motion which he filed pursuant to 28 U.S.C. Sec. 2241 (1988). We have reviewed the record and the district court's opinion and find no reversible error. Accordingly, we affirm on the reasoning of the district court. Borromeo v. United States, No. CA-94-126 (N.D.W.Va. Mar. 22, 1995). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the court and argument would not aid the decisional process.
